Lawsuit: Sacramento PD shot naked man with rubber bullets, sicced dog on him

SACRAMENTO -- Keith Kelly filed a federal complaint on July 28 in the U.S. District Court for the Eastern District of California against the City of Sacramento and its police force for negligence and intentional bodily harm.

According to the complaint, on Oct 10, 2020, Kelly was inside the home of a neighbor when the Sacramento Police Department (SPD) arrived at the residence and ordered Kelly to exit the home with his hands up. 

Kelly allegedly exited the residence, completely nude, unarmed and with his hands in the air. Kelly began walking down the home's driveway and stopped approximately 25-30 feet in front of officers when the officers allegedly shot rubber bullets and beanbags, causing Kelly to collapse. 

Kelly alleges that the officers then brought out a K-9 unit that began attacking him for 20-30 seconds before an officer called the dog off of him. Officers then allegedly placed Kelly in handcuffs.

Kelly seeks general, special, punitive damages, attorney's fees and cost of suit. Kelly is represented by John L. Burris.
