Two men sue Tropicale Foods for misrepresentation

SAN FRANCISCO - Leona Tavake and Sergio Perez filed a federal class action complaint on August 5 in San Francisco against Tropicale Foods, LLC.

According to the complaint, Tropicale Foods manufactures, labels, markets and sells paletas, with the representation Helados Mexico emblazoned on the front of its products. This is false representation that leads customers to believe that the products are from or made in Mexico, which they are not. 

Plaintiffs seek a declaration that Defendant is financially responsible for notifying the class members of the pendency of this suit; a declaration that Defendant has committed the violations, monetary damages, injunctive relief, punitive damages, attorney's fees and cost of suit. The plaintiffs are represented by Michael R. Reese of Reese LLP.
