SAN FRANCISCO - Robert Weiss filed a federal class action complaint on August 17 in the Northern District of California against American Standard Brands for violation of California law.
According to the complaint, American Standard Brands sells Champion brand toilet gasket and/or flush valve assembly. Weiss alleges that the gasket and/or flush valve assembly prematurely fails and necessitates frequent repairs and constant monitoring to prevent water waste.
The purpose of the gasket and/or valve assembly is to prevent water in the holding tank from draining until the user flushes the toilet. In a relatively short period of time, the gasket and/or valve assembly may blister and fill with water, preventing a watertight seal, the suit says.
The leak path can also cause the toilet to periodically flush on its own, also known as “ghost-flushing," the suit says. The defective product caused Weiss to sustain damages which include, but are not limited to, repair or replacement costs, increased water bills, diminution in value of the toilet, overpayment at the time of purchase, and other related costs, the suit says.
