This webinar will provide the liability insurer’s perspective on consent judgments. The presenters will discuss these questions:
- What are the mechanics of the consent judgment process? Typically, it includes a covenant not to execute, an assignment of rights, and a judgment stipulated between the policyholder and the underlying plaintiff, aka "consent judgment."
- What conditions must be satisfied before a policyholder can enter into a consent judgment?
- What standards do courts use to determine whether to enforce a consent judgment against liability insurers? Conversely, what tools does an insurer have to challenge the enforcement of a consent judgment?
