A teenager has filed a sexual harassment lawsuit against retailer Old Navy, claiming that she and several female employees were harassed by an assistant manager and that complaints to company management went ignored.
Plaintiff Jane Doe filed a lawsuit in San Francisco County Superior Court against Old Navy, and several individuals, citing allegations of sexual harassment, sexual assault and battery and wrongful constructive discharge.
According to court documents, Doe is a 16-year-old former employee of the Old Navy store in Daly City, California. The plaintiff alleges that during her employment, she was subjected to a pattern of sexual harassment and assault perpetrated by her female manager.
The manager is accused of engaging in inappropriate behavior with numerous young female employees, including alleged unwanted touching and making inappropriate comments.
The plaintiff and her co-workers reportedly made multiple complaints to the store's general manager, both verbally and in writing, which were allegedly ignored for over a month. No effective action was taken, leading to further harassment. The plaintiff eventually felt compelled to resign from her job due to the ongoing harassment and the company's failure to address the issue.
Old Navy is accused of vicarious liability for the female manager's actions and for failing to conduct a prompt and thorough investigation into the matter.
Doe is requesting a jury trial to seek damages for emotional distress, along with other damages plus attorneys' fees, interest, court costs and other relief.
