Class action accuses private school operator Fusion Learning of violating California wage and labor laws

Fusion Learning Inc., a private school operator, is facing a class action lawsuit for allegedly violating California wage and labor laws. 

The plaintiff, Jason Lobaton, accuses the company of shorting worker pay and other alleged violations of California labor law. The alleged violations include unpaid minimum wages, unpaid overtime, unpaid meal period premiums, untimely payment of final wages and wages, non-compliant wage statements, failure to keep requisite payroll records, unreimbursed business expenses and violation of California Business & Professions Code.

The lawsuit was filed in San Francisco County Superior Court on Jan. 16. The plaintiff seeks monetary damages, restitution, statutory penalties and other equitable relief. 

The attorneys representing Lobaton and the putative class are Robert W. Ottinger and Lynsey D. Johnson, from The Ottinger Firm P.C., based in San Francisco.
