A class action lawsuit accuses Dignity Health of allegedly wrongly not reimbursing its managers for business expenses, including for their personal cell phones and home internet service, which they say the company allegedly requires them to use to complete their work assignments and duties.
On March 4, attorneys Edward J. Wynne and George R. Nemiroff, of the Wynne Law Firm, of Larkspur, filed suit in San Francisco County Superior Court on behalf of named plaintiff Catherine Husted, of Lincoln, California, who allegedly worked as a nurse manager for Dignity Health at Mercy San Juan Medical Center in Carmichael.
The lawsuit will seek to expand the action to include all managerial staff at all Dignity Health locations in the past four years, which the complaint estimates could include hundreds of people.
The lawsuit accuses Dignity Health of violating California's Unfair Competition Law (UCL) and state labor laws by allegedly not paying them to reimburse certain telecommunications and internet expenses the plaintiffs said Dignity requires its managerial staff to pay as part of their jobs.
The plaintiff seeks reimbursement for business expenses and interest, restitution, declaratory and equitable relief, and reasonable attorneys’ fees and costs under California laws.
