Class action accuses Roadrunner Transportation Services of allegedly violating CA labor laws

SAN FRANCISCO - Two forklift operators have filed a class action lawsuit against trucking firm Roadrunner Services, accusing the company of allegedly violating California labor laws.

Named plaintiffs Joseph Rojas and Johnathan Babakitis filed the lawsuit in San Francisco County Superior Court on March 19.

The plaintiffs allege that Roadrunner failed to pay wages earned, including performance-based bonuses, and did not provide timely and uninterrupted meal and rest periods. They also accuse the company of allegedly failing to furnish timely and accurate wage statements, not paying all wages due upon termination, and violating California's Unfair Competition Law.

The plaintiffs seek to expand the lawsuit to include hundreds of other workers for the defendant company in California. They are seeking court orders requiring the defendant to pay unspecified damages, including allegedly unpaid wages, statutory damages, liquidated damages, statutory penalties and attorney fees.

Plaintiffs are represented by attorneys Isam Khoury, Michael D. Singer and Maggie Realin, of the firm of Cohelan Khoury & Singer, of San Diego, and David R. Markham and Lisa Brevard, of The Markham Law Firm, of La Jolla.
