Class action accuses Banner Health of allegedly violating California labor law

A class action lawsuit has accused Banner Health of allegedly violating California's labor laws. 

According to its website, the Arizona-based Banner currently operates one California location in Susanville, and nowhere else in the state, but operates dozens of facilities throughout Arizona, Colorado, Wyoming and Nevada, among other locations. 

The lawsuit was initially filed in February in Lassen County Superior Court, but was removed to the U.S. Eastern California District Court on March 22.

The plaintiff, Vincent Kelly, alleges that the company failed to provide meal and rest periods, pay overtime wages at the correct rate, pay proper sick time pay, provide accurate wage statements, reimburse necessary business expenditures and pay all final wages following separation of employment. 

The lawsuit seeks to expand the action to include everyone who worked for Banner Health in California in the past four years.

Plaintiffs are represented by attorneys Emil Davtyan, David Ycrcmian, David Keledjian and David Arakelyan, of D. Law Inc., of Glendale.
