Class action: Pathways shorted teachers OT pay, other alleged labor law violations

Pathways Travel is facing a class-action lawsuit for allegedly failing to pay its teachers overtime wages. The suit, filed by Nicholas Moore on behalf of himself and other "Day Rate Employees," accuses the company of various violations of wage and labor laws.

The complaint alleges that Pathways Travel misclassified its Day Rate Employees as exempt teachers and paid them a flat daily rate, regardless of the total number of hours worked in a week. The company allegedly did not compensate these employees for overtime work, allegedly as required by law.

The suit further argues that Pathways Travel is not an educational establishment but rather a travel company catering to students. It asserts that the company's uniform day rate pay scheme allegedly violates the federal Fair Labor Standards Act, the California labor code, Colorado wage laws, the D.C. Minimum Wage Act and the Illinois Minimum Wage Law.

The case was filed in the U.S. District Court for the Northern District of California on April 1. Attorney William M. Hogg from Josephson Dunlap LLP is representing the plaintiffs.
