Br.C. sues Be.C. for a domestic violence restraining order

In the Court of Appeal of the State of California, Third Appellate District, a case has been filed by plaintiff Br.C. against defendant Be.C., identified as case number C097015. The lawsuit, dated April 5, 2024, revolves around a domestic violence restraining order (DVRO) that protects the plaintiff, their two children and their dogs from the defendant for a three-year period.

The case was heard by Judge Frances A. Kearney of the Superior Court of Placer County. The plaintiff's lawyer is Trevor L. Hensley from Herrig, Vogt & Hensley while the defendant represented himself. On March 16, 2022, an incident occurred where Be.C. allegedly screamed at Br.C., lunged at her and threw hot soup into the sink which splashed onto one of their children. This led to Br.C. obtaining an emergency protective order against Be.C.

Further evidence presented in court included daily derogatory name-calling by Be.C., nightly disturbances involving slamming cabinets and throwing water bottles at walls for approximately a year. Audio recordings from February 12, 2022 were also admitted where Be.C was heard yelling at Br.C in front of their children and refusing to let her out of a car during an argument.

The plaintiff seeks to uphold the DVRO granted by the trial court after hearing eight witnesses and considering numerous exhibits. Although physical abuse evidence was not substantial, there was enough evidence demonstrating conduct that destroyed Br.C.'s mental or emotional calm and placed her in apprehension of serious bodily injury.
