Jameal M. Mosley sues The Superior Court of Sacramento County and The People for denial of motion to suppress evidence

In the Court of Appeal of the State of California, Third Appellate District, Jameal M. Mosley has filed a petition against The Superior Court of Sacramento County and The People, under court case ID C099530 on April 5, 2024. The lawsuit pertains to the denial of Mosley's motion to suppress evidence obtained from warrantless searches of his car and person.

On July 19, 2023, the Sacramento County District Attorney charged Mosley with unauthorized possession and transportation of a machine gun, being a felon in possession of a firearm for the benefit of a street gang, and being a felon in possession of ammunition. These charges stemmed from warrantless searches that yielded a loaded magazine and Glock handgun with an automatic switch.

Mosley's legal representation includes Amanda Benson, Public Defender, Kyle Hofmeister and David A. Anguiano, Assistant Public Defenders. For the Real Party in Interest (The People), Rob Bonta is serving as Attorney General with Lance E. Winters as Chief Assistant Attorney General; Michael P. Farrell is Assistant Attorney General while Christopher J. Rench and Jamie A. Scheidegger are Deputy Attorneys General.

Mosley seeks to have the fruits of these searches suppressed on grounds that they were unsupported by probable cause or reasonable suspicion. He contends that the trial court erred in finding otherwise.
