Medic Ambulance Service, Inc. has filed a lawsuit against Sacramento Metropolitan Fire District in the Court of Appeal of the State of California, Third Appellate District, with the court case ID C096783 on April 25, 2024. The suit is about a breach of express and implied contract, promissory estoppel, and breach of the covenant of good faith and fair dealing.
The plaintiff, Medic Ambulance Service, bid on a contract to provide ambulance services to the defendant, Sacramento Metropolitan Fire District. Relying on communications from district staff and agents as well as a document stating the district’s intent to award the contract to Medic, Medic prepared for providing the services. However, all bids including Medic's were rejected by the district’s Board of Directors.
Medic sued the district after its third amended complaint was dismissed without leave to amend following a sustained demurrer by the district. Medic argues that it sufficiently alleged all four causes of action and urges for an opportunity to pursue promissory estoppel theory.
Medic is seeking judgment for breach of express and implied contract, promissory estoppel, and breach of covenant of good faith and fair dealing. The plaintiff contends that they had taken steps in preparation for providing services based on communications from district staff and agents which led them to believe they would be awarded the contract.
Justices Mesiwala, Hull and Renner all concur that the Medic's arguments fail to address or overcome the relevant legal barriers to its promissory estoppel claim and that the district demurrer was properly sustained. The judgment of the lower court is affirmed.
