In the Superior Court of California, County of Santa Clara, plaintiff Martin Moroz, represented by Attorney Alexei Kuchinsky of Kuchinsky Law Office, has filed a lawsuit against defendant David Albert and Does 1 through 5. The case, identified as 24CV436625 and dated April 24, 2024, involves strict liability (dog bite statute), common law strict liability, premise liability, and negligence.

Moroz alleges that he was bitten by Albert's dog while delivering a package to the defendant's home. The incident occurred on February 7, 2024 at Albert's residence located at 141 Marianna Way, Campbell CA. The damages sought in this matter exceed $25,000.

The plaintiff is seeking compensation for negligence and strict liability against the defendants for injuries sustained during the incident. He alleges that Albert's dog attacked him without a leash or collar and bit his right wrist and arm causing deep puncture wounds which required medical attention including x-rays on his wrist and arm, shots, and other measures to address the deep dog bites.
