Man accuses Good Samaritan Hospital and unnamed defendants of medical negligence

In the Superior Court of California, County of Santa Clara, plaintiff James K. Atkins, represented by Lilia Bulgucheva from Bulgucheva Law, P.C., has filed a lawsuit against Good Samaritan Hospital and 20 unnamed defendants (DOES 1-20). The case was filed under ID 24CV438629 on May 8, 2024. The complaint alleges medical negligence on the part of the defendants.

Atkins claims that he contracted a staph infection at an intravenous site in his right arm during treatment at Good Samaritan Hospital on May 21, 2023. The hospital had initially treated him for right flank pain and concluded that he must have passed a kidney stone. A week later, Atkins returned to the hospital with shortness of breath and diffuse pain in various parts of his body. He was then treated for severe sepsis.

The plaintiff alleges that as a direct result of the defendants' conduct, he has sustained injuries to his health, strength and activity causing great mental, physical and emotional pain and suffering. His damages exceed the minimum jurisdictional limits of the court.

Atkins is seeking damages for pain and suffering caused by alleged medical negligence on part of Good Samaritan Hospital and other unnamed defendants. He had served a Notice of Intention to Commence Action Against Health Care Provider pursuant to C.C.P. §364 on Defendants before filing this lawsuit.
