Plaintiff alleges city and county of San Francisco and DFS Group negligence in personal injury suit

In a recent legal filing, Sook Jung has lodged a personal injury and damages complaint against the City and County of San Francisco (CCSF) and DFS Group L.P. The complaint was filed on May 16, 2024, in the Superior Court of California, County of San Francisco, under Case No. CGC-24-614694.

According to the details outlined in the complaint, Plaintiff Sook Jung alleges that on April 10, 2023, she sustained severe injuries after tripping over an inconspicuously angled curb near the entrance of DFS Group L.P.'s storefront in Terminal A at San Francisco International Airport. Jung asserts that this hazardous floor condition constituted a dangerous public property defect for which CCSF and DFS Group L.P. are responsible.

The plaintiff's legal team, represented by Constantine Panagotacos from Dunn & Panagotacos LLP, claims that both CCSF and DFS Group L.P., failed to maintain safe conditions at the accident location. "Plaintiff is informed and believes that Defendants CCSF and Does 1-20 were responsible for designing, constructing, maintaining, servicing, repairing, altering, managing, improving, inspecting or otherwise ensuring the safety of the premises," reads one part of the complaint.

Jung's complaint further details that she had served a written Government Claim for Damages to CCSF on October 6, 2023. This claim was subsequently denied on November 17, 2023. The lawsuit has been filed within six months following this denial as per legal requirements.

The first cause of action accuses CCSF of creating a dangerous condition of public property under Government Code Section 835. The code stipulates liability if it can be shown that the property was in a dangerous condition at the time of injury and that such a condition posed a foreseeable risk which could have been mitigated by appropriate measures. Jung alleges negligence on part of CCSF and its contractors for failing to address or warn about this hazardous condition despite having actual or constructive notice.

In her second cause of action against all defendants including DFS Group L.P., Jung accuses them of negligence due to their failure to place adequate warning signs or guardrails around the hazardous area. "Defendants negligently failed to maintain and/or inspect the accident location; and/or otherwise acted negligently to cause and/or contribute to the incident," states another section from her complaint.

As relief from these alleged wrongdoings, Sook Jung seeks general and special damages according to proof presented during trial. She also requests prejudgment interest along with coverage for costs incurred during litigation.

Representing Jung is attorney Constantine Panagotacos from Dunn & Panagotacos LLP. The case will be presided over by judges assigned within the Superior Court of California in San Francisco under Case ID CGC-24-614694.
