Plaintiff alleges negligence against driver following collision resulting in injuries

In a recent court filing, Farshid Ebadati has lodged a personal injury complaint against Samiullah Shinwar and unnamed defendants in the Superior Court of California, County of Sacramento. The complaint, filed on May 16, 2024, alleges negligence resulting in significant injuries and property damage stemming from a vehicular collision.

The incident occurred on February 21, 2023, at the intersection of Northrop Avenue and Fulton Avenue in Sacramento. According to the complaint, Ebadati was driving northbound on Fulton Avenue when Shinwar, operating a 2017 Mercedes E300 westbound on Northrop Avenue, allegedly ran a red light and collided with Ebadati's vehicle. The plaintiff asserts that Shinwar's negligent driving caused severe injuries to his health and substantial damage to his vehicle.

Ebadati's legal representation from Clayeo C. Arnold Law Corporation argues that the defendants' actions have led to ongoing physical pain and suffering for their client. "As a direct result of Defendants’ failure to exercise due care," states the complaint, "Plaintiff Farshid Ebadati was hurt and injured in his health, strength, and activity." The document further details that these injuries have resulted in mental anguish and loss of enjoyment of life for Ebadati.

The plaintiff also claims that he has incurred significant medical expenses due to the accident and anticipates future costs related to ongoing treatment. Additionally, Ebadati alleges that his injuries have impeded his ability to work, leading to lost earnings and diminished earning capacity. The complaint notes that these financial losses will be substantiated with evidence during the trial.

Beyond personal injury claims, Ebadati is seeking compensation for property damage sustained in the collision. He contends that Shinwar's carelessness deprived him of the use of his vehicle and other personal property. The plaintiff seeks general damages exceeding $35,000 along with special damages covering medical expenses, loss of income, property damage, prejudgment interest calculated from the time the cause of action arose as per California Civil Code provisions, court costs, and any additional relief deemed appropriate by the court.
