Minor Sues Dog Owners Over Vicious Attack

In a recent court filing, Jericko Pitnikoff, a minor represented by his Guardian ad Litem Jeff Pitnikoff, has lodged a complaint for damages against Monica Alfaro and Jose Castellanos. The complaint was filed in the Superior Court of California, County of Sacramento on April 23, 2024.

According to the complaint, Jericko Pitnikoff alleges that he was viciously attacked and bitten by a dog owned by the defendants while he was lawfully present at or near their premises on February 27, 2024. The plaintiff claims that the dog, described as a German Shepherd named Vader, had known vicious and dangerous propensities. Despite this knowledge, Alfaro and Castellanos allegedly failed to contain or remove the dog from their property located at 7917 Titan Drive in Antelope, California.

The complaint further states that Jericko suffered serious physical injuries as a result of the attack. These injuries include damage to his shoulders, back, and arms, as well as severe shock to his nervous system. "Plaintiff was caused to and did sustain serious physical injuries including but not limited to injuries to his shoulders, back, and arms," reads the complaint. The plaintiff also claims ongoing pain and suffering due to these injuries.

The first cause of action cited in the complaint is strict liability under California Civil Code § 3342. This statute holds dog owners strictly liable for damages if their dog bites someone while that person is in a public place or lawfully in a private place. The second cause of action is negligence and premises liability against all defendants. It asserts that Alfaro and Castellanos were negligent in managing their property and controlling their dog.

Jericko Pitnikoff seeks general damages according to proof for his physical injuries and emotional distress. He also seeks special damages for medical expenses incurred due to the attack and any future medical costs related to his recovery. Additionally, he requests compensation for the costs of suit incurred.
