Plaintiffs Allege Negligence Against Property Management Firm Following Severe Injury Incident

Daniel Dixon and Karen Dixon have filed a personal injury complaint against Wolff Principal Holdings, LP., The Wolff Company LLC, and Wolff Holdings LLC. The complaint was filed on May 16, 2024, in the Superior Court of California, County of Sacramento.

The plaintiffs allege that Daniel Dixon suffered severe injuries on August 18, 2022, while legally present on the defendants' premises at 800 J Street, Sacramento, CA. According to the complaint, a garage door fell on Daniel Dixon's neck causing significant harm. The plaintiffs claim that the defendants were aware or should have been aware of the dangerous condition that led to the incident. They argue that the defendants negligently caused or permitted the premises to be in a hazardous state by failing to properly manage, maintain, inspect, and supervise the area.

The complaint outlines two causes of action: premises liability negligence and loss of consortium. In their first cause of action for premises liability negligence, the plaintiffs assert that due to the defendants' negligence in maintaining their property in a safe condition, Daniel Dixon suffered both economic and non-economic damages. Economic damages cited include past and future medical expenses, loss of income and earning capacity, loss of ability to provide household services, incidental and consequential damages as well as property damage. Non-economic damages mentioned encompass physical and mental suffering, loss of enjoyment of life, physical impairment, inconvenience, anxiety, and emotional distress.

In their second cause of action for loss of consortium, Karen Dixon claims she has been harmed by her husband's injuries due to the defendants' negligence. She asserts that she has lost companionship and services from her spouse which include love, comfort, care assistance protection moral support as well as enjoyment of sexual relations.

The plaintiffs are seeking judgment against the defendants for non-economic damages exceeding the jurisdictional limit of the court along with all medical expenses according to proof all loss earnings according to proof prejudgment interest where applicable costs associated with filing suit any other relief deemed just proper by court
