Plaintiff alleges negligence against security company following assault at apartment complex

Indu Surapaneni has filed a negligence complaint against Good Guard Security, Inc., Prism, and Bozzuto Management Company. The complaint was filed on May 22, 2024, in the Superior Court of California, County of San Francisco.

According to the court documents, the incident occurred on August 9, 2022. Plaintiff Indu Surapaneni and her mother were walking towards their home at PRISM Apartments located at 1028 Market Street in San Francisco when they encountered a homeless woman aggressively trying to enter the building. When Surapaneni refused to let her in, the woman assaulted her and followed them into the complex lobby. Despite a security guard being present, no assistance was provided as the homeless woman continued her assault inside an elevator and subsequently stole approximately $3,500 worth of belongings from Surapaneni.

The plaintiff alleges that Good Guard Security, Inc., Prism, and Bozzuto Management Company failed in their duty to provide reasonable care by not intervening during the assault. "Defendants did breach their duty of due care to Plaintiff when each of them unreasonably, negligently, tortiously, and carelessly failed to provide assistance," reads the complaint. The lawsuit further claims that these companies were negligent in hiring and supervising their employees who were unfit for their roles.

Surapaneni asserts that as a result of this negligence she suffered physical injuries as well as psychological trauma. She is seeking general damages according to proof, special damages according to proof, pre-judgment interest, past and future loss of earnings and earning capacity, costs of suit, and any other relief deemed just by the court.

Represented by Nicole H. Dolle from RMD Law LLP, Surapaneni demands a jury trial for all issues so triable. The case is assigned Case No.: CGC-24-614886 with Judge James Xiong presiding over it.
