Jeffrey Brousseau has filed a complaint for damages against the City of Sacramento, alleging governmental liability, premises liability, and negligence. The complaint was filed on May 21, 2024, in the Superior Court of California for the County of Sacramento by attorney Steven D. Baric.
The case stems from an incident that occurred on August 13, 2023, at William Land Regional Park in Sacramento. According to the complaint, Brousseau was walking through the park when a large tree branch suddenly fell and struck him on the head, causing him to lose consciousness and sustain injuries to his head/face, neck, back, and left leg. Brousseau contends that the City of Sacramento failed to maintain the park properly and did not provide adequate warnings about potential hazards. The complaint states that there were no warning signs or barriers in place to prevent pedestrians from entering areas where dangerous conditions existed. Furthermore, it is alleged that the city had prior knowledge of these hazardous conditions but failed to take appropriate measures to mitigate them.
"Defendants knew or should have known that their failure to inspect, manage, warn, control, and/or clean the subject premises created an unreasonable risk of harm," reads one part of the complaint. The plaintiff argues that this negligence directly led to his injuries.
In addition to seeking general damages for pain and suffering, Brousseau is also requesting compensation for past and future medical expenses, lost earnings, loss of earning capacity, pre- and post-judgment interest, and other costs associated with the lawsuit. The plaintiff's legal team is demanding a jury trial for all claims so triable.
