Tenant Sues Property Management Company Over Negligence Leading To Injury

David Chavez has filed a personal injury complaint against Steele Holdings LLC, alleging negligence in maintaining a residential property. The complaint was filed on May 21, 2024, in the Superior Court of California, County of Sacramento.

According to the court documents, David Chavez, a resident of Sacramento County, claims that on March 31, 2023, he suffered severe injuries due to the negligent maintenance of his residence at 3850 44th Ave Apt 5 in Sacramento. Chavez asserts that Steele Holdings LLC., along with unnamed defendants referred to as DOES 1 through 10, failed to ensure the safety of the premises they managed and leased out to tenants.

The incident occurred when Chavez was walking on a common area deck/porch outside his apartment. As per the complaint, "Plaintiff, David Chavez was walking on a common area of the deck/porch located outside of his residence when he stepped on a piece of the floor that was caving in resulting in the Plaintiff falling through the deck/porch breaking his right foot." The lawsuit details how this fall led to significant injuries for Chavez.

Chavez's complaint accuses Steele Holdings LLC and its agents or employees of being aware or reasonably expected to be aware of the hazardous condition but failing to take appropriate action. "Defendant(s) carelessly and negligently operated, managed, and maintained the above-described PREMISES in a dangerous and unsafe condition such as to create an unreasonable and foreseeable risk of harm," states the filing.

As a result of this alleged negligence, Chavez has suffered not only physical injuries but also financial burdens. He claims ongoing medical expenses and an inability to work or perform household services since the incident. The plaintiff further anticipates future losses related to earnings and household contributions due to his prolonged recovery period.

In seeking justice from the court, Chavez is asking for non-economic damages exceeding the jurisdictional limit of the court for pain and suffering. Additionally, he seeks compensation for all medical expenses incurred and future medical costs as well as loss of earnings both past and future. The complaint also requests prejudgment interest where applicable by law and reimbursement for loss related to household services.
