A recent court filing has brought to light a serious car accident that resulted in significant injuries for the plaintiff. The complaint, filed by Darrell Lewis on June 6, 2024, in the Superior Court of California, County of San Francisco, accuses Oscar I. Canas of negligence and negligence per se.
According to the complaint, the incident occurred on January 24, 2023. Darrell Lewis was driving southbound on Mission Street in San Francisco when Oscar I. Canas attempted an unsafe left turn from the right-side lane into Santa Marina Street. This maneuver led to a broadside collision with Lewis's vehicle, causing severe injuries to Lewis. The plaintiff alleges that Canas failed to adhere to proper lane-changing protocols and safe driving practices as mandated by California Vehicle Code §§ 22107 and 22100.
The complaint further elaborates that at all relevant times, both parties were residents of San Francisco. It asserts that Canas was operating a 2015 Toyota Corolla registered under his name and possibly other unknown defendants referred to as DOES 1 through 20. These unnamed defendants are alleged to be legally responsible for the incident due to their ownership or involvement with the vehicle.
Lewis’s legal team argues that Canas had a duty to operate his vehicle responsibly and safely but breached this duty by making an unsafe turn from an incorrect lane without ensuring it could be done safely. This breach directly led to the collision and subsequent injuries sustained by Lewis. The plaintiff contends that such actions were not only negligent but also violated specific traffic laws designed to prevent such accidents.
In addition to negligence, the complaint includes a cause of action for negligence per se based on violations of California Vehicle Code § 22107 and § 22100. These statutes require drivers to ensure safety before changing lanes or making turns and mandate left turns be made from the utmost left-hand lane available. The plaintiff claims these statutory breaches were direct causes of the accident and his injuries.
Darrell Lewis is seeking various forms of relief from the court: special damages according to proof, general damages also according to proof, prejudgment interest as allowed by law, costs incurred during litigation, and any other relief deemed just and proper by the court.
