Healthcare providers accused of medical malpractice by patient's family

A recent court filing has brought to light a medical malpractice case that could have significant implications for the healthcare industry. On June 4, 2024, attorney Erik L. Peterson of Bostwick & Peterson, LLP filed a complaint in the Superior Court of California, County of Santa Clara against Stanford Health Care and several other defendants.

The plaintiffs in this case are Rajiv Krishnarao, represented by his guardian ad litem Priya Krishnarao, and Priya Krishnarao individually. They allege that multiple healthcare providers including Stanford Health Care, Sutter Health, Mills-Peninsula Medical Center, and Dr. Zuolo Liu failed to properly diagnose and treat Rajiv's medical condition. According to the complaint, Rajiv sought medical care from these institutions starting on June 6, 2023, for symptoms such as headache, slurred speech, and facial drooping. Despite being under their care, Rajiv suffered a stroke which led to permanent injury and disability.

The complaint accuses the defendants of negligence in their medical duties. It states that the healthcare providers "carelessly and negligently instructed, evaluated, examined, diagnosed, prescribed for, cared for and treated" Rajiv. This alleged negligence resulted in severe consequences including long-term disability and ongoing medical expenses. The plaintiffs claim that the failure of these institutions to provide adequate care directly led to Rajiv's deteriorating health condition.

Priya Krishnarao also claims loss of consortium due to her husband's condition. She alleges that as a result of the defendants' actions or lack thereof, she has suffered "the loss of support, services, love, companionship, affection, security," among other aspects crucial to their marital relationship.

The plaintiffs are seeking various forms of relief from the court. They request general non-economic damages exceeding the jurisdictional minimum of the court for pain and suffering endured by Rajiv. Additionally, they seek special damages according to proof presented during the trial for incurred medical expenses and future costs related to ongoing treatment. The lawsuit also asks for compensation covering loss of earnings and earning capacity due to Rajiv's inability to work post-injury.

Representing the plaintiffs is Erik L. Peterson from Bostwick & Peterson LLP while the case is being reviewed by Judge P. Hernandez under Case ID 24CV440531.
