Customer Sues San Francisco Auto Shop for Negligence After Violent Attack

A violent altercation at a San Francisco repair shop has led to a lawsuit filed by a customer against the business. On May 31, 2024, Andres Quintero lodged a complaint in the Superior Court of California, County of San Francisco, against Hybrid Repair & Rental Inc., alleging negligence and failure to supervise or train their employees.

According to the complaint, Quintero visited the Hybrid Repair & Rental Inc. shop located at 2330 Lane Street in San Francisco on February 14, 2024. During his visit, he engaged in an argument with an employee regarding the quality of repairs performed on his vehicle. The situation escalated when the employee returned with a crowbar and attacked Quintero, causing significant injuries to his arm and hand as he attempted to defend himself. The plaintiff claims that other employees and the manager did nothing to intervene during the incident.

Quintero's complaint further alleges that Hybrid Repair & Rental Inc. had prior knowledge of this employee's inappropriate behavior but failed to take any corrective action. "Defendants had notice of the employee’s inappropriate behavior and did nothing to remedy it," states the filing. It also suggests that there have been similar incidents at the repair shop previously.

The plaintiff asserts that Hybrid Repair & Rental Inc.'s negligence extends beyond this single event. He accuses them of failing to provide adequate supervision and training for their employees, which he believes directly contributed to his injuries. "Defendants failed to use reasonable care because they did not train or properly supervise their employees or agents regarding proper interactions," Quintero argues in his filing.

Quintero is seeking general and special damages for his physical, mental, and emotional suffering resulting from the attack. Additionally, he requests punitive damages under Section 3294 of the Civil Code of California due to what he describes as malice or oppression by one of the defendant's agents who acted with advance knowledge of unfitness for employment.
