Driver Sues Vehicle Owner for Negligence Following Collision

A tragic car accident has led to a lawsuit alleging negligence and personal injury, filed by Matthew Hamilton against Josephine Tolbert. The complaint was lodged by the Shapiro Legal Group in the Superior Court of California, County of San Francisco, on June 11, 2024.

According to the court documents, Hamilton claims that on June 25, 2022, he was driving his black 2020 Chevrolet Camaro along Russia Avenue at its intersection with Dublin Street in San Francisco when his vehicle was struck by a black 2010 Dodge Grand Caravan owned and operated by Tolbert. The plaintiff asserts that Tolbert and other unnamed defendants (referred to as DOES ONE through FIFTY) negligently managed and operated their vehicle, leading to the collision. "Defendants so negligently and carelessly entrusted, managed, maintained, controlled, owned and operated their above-described vehicle," states the complaint.

Hamilton alleges that the negligence of Tolbert and her associates caused him significant physical injuries and emotional distress. He details suffering from bodily harm, shock to his nervous system, and ongoing mental anguish. The plaintiff also contends that these injuries have resulted in some permanent disability. "Plaintiff was hurt and injured in his health, strength, and activity," reads the document.

Furthermore, Hamilton claims substantial financial losses due to medical expenses incurred for treatment following the accident. He anticipates additional future medical costs as well. The complaint also highlights Hamilton's inability to work post-accident, resulting in lost earnings and diminished earning capacity. Additionally, Hamilton's vehicle sustained damage requiring repairs; he was deprived of its use for a period of time which led to further expenses.

In seeking justice from the court, Hamilton requests general damages according to proof presented during trial. He also seeks compensation for all medical expenses incurred due to the incident as well as loss of earnings both past and future. Furthermore, he demands pre-judgment interest pursuant to Civil Code Section 3291 along with coverage for property damage costs associated with repairing his vehicle.
