Concertgoer Sues Multiple Entities Over Injuries from Thrown Object at Concert

A concertgoer has filed a lawsuit alleging severe injuries and emotional distress caused by a glass mason jar thrown from the stage during a performance. The complaint was filed by Anais Gonzalez in the Superior Court of California, County of San Francisco, on July 5, 2024, against The Warfield Theater, LLC and several other defendants.

According to the court documents, Anais Gonzalez attended the Mac Dre Day concert at The Warfield Theater in San Francisco on July 5, 2022. During the event, an individual on stage allegedly threw a glass mason jar into the crowd without warning. The jar struck Gonzalez in the forehead above her left eye, causing significant injuries including a laceration that required stitches, a concussion, disfigurement, mental and emotional distress, post-traumatic stress disorder (PTSD), and loss of sleep. "Plaintiff immediately sought medical attention and was treated for her injuries," states the complaint.

The lawsuit names multiple defendants including The Warfield Theater Property Owner’s Association, Thizz Entertainment LLC, Anschutz Entertainment Group Inc., Goldenvoice LLC, and several individuals associated with the event. Gonzalez claims these entities and individuals were negligent in their duty to ensure the safety of attendees. "Defendants negligently owned, maintained, managed and operated the Warfield Theater," alleges Gonzalez.

Gonzalez's legal action includes four causes of action: premises liability, intentional infliction of emotional distress (IIED), negligent infliction of emotional distress (NIED), and general negligence. In her premises liability claim, she asserts that all named defendants failed to provide a safe environment for concertgoers. "Defendants willfully failed to warn Plaintiff...that a person or persons on the performance stage would be throwing glass mason jars into the crowd," reads one part of the complaint.

In her IIED claim, Gonzalez accuses the defendants of acting recklessly with intent to excite the crowd but disregarding potential harm to attendees. She states that this reckless behavior led directly to her physical and emotional suffering. Similarly, in her NIED claim, she argues that defendants should have known their actions would likely result in harm if they did not intervene or regulate such conduct.

Gonzalez is seeking various forms of relief from the court including actual and compensatory damages for her injuries and suffering; consequential damages; general damages for mental and emotional distress; payment for costs incurred; pre-judgment interest; punitive damages aimed at deterring similar future conduct; as well as any other relief deemed appropriate by the court.

The case is being handled by Arturo Hernandez-M., attorney at law representing Anais Gonzalez. It has been assigned Case No. CGC-24-616204 in front of Judge [Name], filed under premises liability among other claims.
