California Woman Sues Property Owners Over Dog Attack Injuries

A California woman has filed a lawsuit alleging severe injuries from a dog attack. On July 17, 2024, Jeananne Campbell filed the complaint in the Superior Court of California, County of Santa Clara, against Flora Marie Bergstrom and others.

The case stems from an incident on October 21, 2022, when Campbell was lawfully present at a property located at 936 Brook Way in Gilroy, California. According to the complaint, she was viciously attacked by a dog owned by Bergstrom and sustained significant injuries to her left ring finger. The plaintiff asserts that the defendants had exclusive control over the maintenance of the property and failed to exercise ordinary care to prevent dangerous conditions.

Campbell's complaint outlines multiple causes of action: negligence, statutory liability under the dog bite statute, strict liability, and premises liability. She claims that Bergstrom and co-defendants Roy Garcia and Sunday Degallery were negligent in their ownership and control of the dog. "Defendants breached such duty when they negligently, carelessly, recklessly, and/or unlawfully owned, controlled, and/or maintained the dog," states the complaint. Campbell alleges that this negligence led directly to her physical harm.

The plaintiff is seeking various forms of relief from the court. These include compensation for past and future economic damages such as medical expenses and loss of earnings. Additionally, she seeks non-economic damages for pain and suffering, pre-judgment and post-judgment interest as allowed by law, costs of suit, and any other relief deemed just by the court.
