Plaintiff Alleges Negligence Against Truck Repair Company After Ladder Fall Incident

A recent court filing has brought to light a harrowing incident involving a trailer repair gone wrong, leading to severe injuries for the plaintiff. Muhammad K. Aslam filed a complaint in the Superior Court of California, Sacramento County, on July 18, 2024, against 5 Star Truck Repair Corp and its employee Ather Iqbal.

The lawsuit stems from an incident that occurred on September 25, 2023. According to the complaint, Aslam had taken his trailer to 5 Star Truck Repair Corp for floor repairs. The company assured him that the repairs would be completed within two to three days. When Aslam returned to pick up his trailer on September 25th, he was asked by Iqbal to inspect the repairs. The inspection required climbing an old aluminum ladder that was positioned on uneven ground. During the descent from the trailer, the ladder tipped over, causing Aslam to fall onto a hard concrete floor and sustain serious injuries.

The complaint details how Aslam fell on his left elbow and experienced excruciating pain immediately after the fall. Despite being in shock and unable to comprehend what had happened for several minutes, he was eventually assisted by Iqbal and other employees of 5 Star Truck Repair Corp. Instead of calling an ambulance as requested by Aslam, Iqbal suggested calling an Uber for him, which Aslam declined.

Aslam's injuries were severe enough that he had to drive himself in great discomfort back home before being taken by his wife to Woodland Emergency Room. There, he was diagnosed with a fractured left elbow that required significant surgery involving the placement of screws for support on October 4, 2023.

The plaintiff alleges that both defendants were negligent in their duty of care by failing to maintain safe premises and equipment. Specifically, they are accused of not replacing or securing the worn-out ladder placed on uneven ground which led directly to Aslam's fall and subsequent injuries. The lawsuit claims that this negligence has resulted in substantial medical expenses, ongoing pain and suffering, wage loss, and potentially future medical care needs.

As part of his legal action, Aslam is seeking compensatory and general damages according to proof at trial. He also demands reimbursement for medical expenses incurred due to the injury, compensation for lost wages and loss of earning capacity, pre-judgment interest according to proof at trial time, costs of suit including attorney fees incurred during litigation proceedings.
