Sacramento Resident Sues Driver Over Negligence Resulting in Severe Injuries

A Sacramento resident is seeking justice after a traffic accident left her with significant injuries and damages. Yvette Plummer filed a complaint on July 6, 2024, in the Superior Court of California, County of Sacramento, against Jose Sanchez-Avila and unnamed defendants referred to as DOES 1 through 10.

According to the complaint, Plummer alleges that on September 12, 2022, she was stopped at a red light on Mack Road in Sacramento when Sanchez-Avila rear-ended her vehicle. Plummer was driving a 2013 Chevy Impala at the time of the incident. The complaint asserts that Sanchez-Avila was operating a 2006 Nissan Armada LE with the knowledge and consent of the other unnamed defendants. It further states that Sanchez-Avila was traveling too fast for the conditions of the roadway, thereby violating California Vehicle Code §22350.

Plummer's attorney, Joseph A. Welch from the Law Offices of Joseph A. Welch in Sacramento, claims that due to Sanchez-Avila's negligence, Plummer suffered severe injuries affecting her health, strength, and activity levels. The lawsuit details how these injuries have caused ongoing physical and mental suffering for Plummer. "Plaintiff is informed and believes and thereon alleges that said injuries would result in some permanent disabilities," reads part of the complaint.

The filing also mentions that Plummer has incurred medical expenses due to the accident and will continue to do so in the future. She is also unable to attend her usual occupation because of her injuries. The exact amount of these expenses is currently unknown but will be amended into the complaint once determined.

In terms of relief sought from the court, Plummer is asking for general damages exceeding $35,000—the minimum jurisdictional limit for this type of case—as well as compensation for all medical and incidental expenses incurred due to the accident. Additionally, she seeks compensation for loss of earnings and property damage along with pre-judgment interest on all general and special damages as per Civil Code section 3291.

The case has been assigned Case No.: 24VWOTSO28 in the Superior Court of California under unlimited jurisdiction. Attorney Joseph A. Welch represents Yvette Plummer while M. Chapman serves as Deputy Clerk overseeing this filing.
