Patient Alleges Medical Negligence Against Folsom Surgery Center Following Unauthorized Procedure

A recent court filing reveals a shocking case of alleged medical negligence that has left a patient suffering severe physical and emotional distress. Amber Clarkson filed the complaint in the Superior Court of California, County of Sacramento, on August 1, 2024, against Folsom Surgery Center, Inc., James C. Yee Medical Group, James C. Yee, M.D., Inc., James C. Yee, M.D., Henry M. Habra, M.D., and other unnamed defendants.

According to the complaint, Amber Clarkson underwent a tonsillectomy on May 10, 2023. However, during the procedure, not only were her tonsils and adenoids removed but also her uvula—without her prior knowledge or consent. The lawsuit claims that this unauthorized removal has led to significant health issues for Clarkson.

The plaintiff's attorney argues that the defendants failed to exercise the degree of care and skill expected from medical practitioners in their community. "Defendants negligently treated, cared for, diagnosed...failed to obtain informed consent," states the complaint. It further alleges that this negligence resulted in injuries including anxiety and emotional distress.

Clarkson asserts that as a direct result of this medical negligence, she has suffered grievous injury to her body and nervous system causing great mental and physical pain. She claims these injuries will likely result in permanent disability and is seeking general damages exceeding $25,000. Additionally, she anticipates incurring substantial future medical expenses for ongoing treatment related to her injuries.

The plaintiff is seeking several forms of relief from the court: general damages according to proof at trial; compensation for past and future medical expenses; damages for loss of earnings; incidental expenses incurred due to the incident; pre-judgment interest on all items of damages; and any other relief deemed just by the court.
