Motor Vehicle Accident Victim Sues Alleged Negligent Driver for Damages

A serious motor vehicle accident has led to a lawsuit filed in the Superior Court of California, County of San Francisco. On August 5, 2024, Jorge Salvador Magarin initiated legal action against Rachael Christine Davini, alleging negligence that resulted in significant physical and emotional injuries.

According to the complaint filed by Magarin, represented by attorneys Sahm Manouchehri, Shabnam Sarani, and Fabi Behnam from Lyfe Law LLP, the incident occurred on March 13, 2024. The plaintiff claims that while parked on South Canal Street facing eastbound, his vehicle was suddenly struck by a car driven by Davini. The collision allegedly caused extensive physical injuries to Magarin. "Defendant so negligently entrusted, managed, maintained, drove and operated their vehicle so as to proximately cause Defendants’ vehicle to strike Plaintiff's auto," states the complaint.

Magarin asserts that Davini and other unnamed defendants (referred to as DOES 1 through 100) violated various traffic safety laws and regulations. These include maintaining control of a vehicle and traveling at a safe speed for conditions. The plaintiff believes these violations directly contributed to the accident and his subsequent injuries. "As a direct and proximate result of the conduct of the Defendants... Plaintiff was injured in health, strength and activity," reads the complaint.

The plaintiff is seeking general and special damages exceeding $35,000. Additionally, he is requesting pre-judgment interest under California Civil Code section 3291 due to ongoing physical pain, mental anguish, and financial strain caused by medical expenses incurred from treating his injuries.
