Patron Sues Local Restaurant for Negligence After Slip-and-Fall Incident

A recent court filing reveals a dramatic slip-and-fall incident at a local restaurant, leading to severe injuries and a lawsuit. Plaintiff Sean Fikes filed the complaint in the Superior Court of California, County of Santa Clara, on August 7, 2024, against Burrito Factory and its employees Soledad Quiroz and Rogelio Hernandez.

According to the complaint, Fikes was injured on June 2, 2024, while visiting the Burrito Factory located at 124 Blossom Hill Rd, San Jose. The plaintiff alleges that he slipped on an unknown liquid near the restroom entrance due to the absence of warning signs or barriers. Fikes contends that this negligence led to his severe physical injuries and emotional distress. "Plaintiff unknowingly stepped on the wet floor, slipped, and fell on the ground," states the complaint.

The lawsuit details that Burrito Factory is a duly licensed corporation in California and was responsible for maintaining safe premises. The plaintiff asserts that both Quiroz and Hernandez were acting within their roles as office manager and branch manager respectively when they failed to ensure safety measures were in place. The complaint accuses them of negligence in their duty to inspect and maintain the premises properly.

Fikes is seeking compensatory damages for his injuries which include physical pain, mental suffering, medical expenses, and lost earnings. He also demands interest based on damages along with pre-judgment and post-judgment interest as allowed by law.

Representing Fikes are attorneys Shahab Mossavar-Rahmani and Ali Faal from Omega Law Group PC. The case has been assigned Case No. 24CV444817 under Judge M. Suarez.
