Woman Sues Fast-Food Giant Over Allegedly Undercooked Hamburger

A woman has filed a lawsuit against a fast-food giant, alleging severe injuries from consuming an undercooked hamburger. Kiayetta Beverly Latish lodged the complaint in the Superior Court of California, County of Sacramento, on August 9, 2024, targeting McDonald's Corporation and Klair Management Enterprises.

According to the court documents, Latish claims that on August 22, 2022, she purchased a hamburger from a McDonald's restaurant located at 8140 Gerber Road in Sacramento. Shortly after beginning her meal, she experienced intense pain and nausea upon realizing that the burger was severely undercooked. The plaintiff alleges that this incident led to significant physical injuries and long-lasting emotional distress. "The result of the subject incident was that Plaintiff sustained physical injuries and permanent and severe emotional distress normally related to the subject incident and injuries sustained," states the complaint.

Latish's lawsuit accuses McDonald's Corporation and Klair Management Enterprises of multiple legal violations including strict liability, breach of warranty, negligence, and negligence per se. The complaint asserts that both defendants were responsible for ensuring their food products were safe for consumption but failed in their duty by serving an adulterated product. Specifically, it alleges that "the adulterated food product that Defendants...manufactured, prepared, distributed, and/or sold was...defective and unreasonably dangerous for its ordinary and expected use because it was severely undercooked."

The plaintiff is seeking various forms of relief from the court. She requests general damages for her physical and emotional suffering as well as special damages covering medical expenses, loss of earnings, property damage, and other related costs. Additionally, she seeks compensation for future medical needs arising from the incident.
