Plaintiffs Allege Negligence Against Local Eye Care Provider Over Botched Surgery

A shocking medical malpractice lawsuit has been filed in Sacramento, alleging severe negligence and product defects that left a patient with ongoing health issues. On August 8, 2024, attorneys from Brelsford Androvich & White filed the complaint in the Superior Court of California, County of Sacramento, against a local eye care provider and a medical device manufacturer.

The plaintiffs, Jennifer Thomas and her husband Keith Thomas, are suing Bradley Barnett, M.D., California Lasik and Eye, RX Sight, and other unnamed defendants for damages exceeding $25,000. The lawsuit claims multiple causes of action including medical malpractice, strict products liability, manufacturing defect, failure to warn, negligence, and loss of consortium. According to the complaint, Jennifer Thomas underwent an adjustable light lens surgery on June 5, 2023. During the procedure at California Lasik and Eye by Dr. Bradley Barnett, a "haptic" on the lens broke due to improper handling. This mishap extended what was supposed to be a 20-minute procedure into nearly four hours of excruciating pain for Jennifer Thomas.

Jennifer's ordeal didn't end there. She continued to suffer complications requiring ongoing optical care. Dr. Barnett allegedly admitted post-surgery that he had prior issues with these lenses breaking but proceeded without having the proper tools to address such problems during her surgery. The plaintiffs argue that this admission is evidence of gross negligence.

In addition to medical malpractice claims against Dr. Barnett and California Lasik and Eye for their substandard care leading to physical injuries and mental anguish for Jennifer Thomas, the lawsuit also targets RX Sight for product liability issues. The complaint alleges that RX Sight's light adjustable lens was defectively designed and manufactured. Furthermore, it accuses RX Sight of failing to adequately warn users about potential risks associated with their product despite being aware of these dangers.

Keith Thomas is also seeking damages for loss of consortium due to his wife's prolonged suffering and inability to perform her usual duties or provide companionship as before. The plaintiffs seek general damages exceeding the court's minimum jurisdictional limits along with compensation for past and future medical expenses according to proof presented at trial.

Representing the plaintiffs are attorneys from Brelsford Androvich & White with William L. Brelsford Jr., specifically named in the filing documents. The case will be presided over by judges from the Superior Court of California in Sacramento under Case No: 2A yfotsG4o.
