California Resident Sues Stanford Health Care Over Alleged Negligence Leading to Severe Injuries

In a shocking turn of events, a California resident has filed a lawsuit against a prominent healthcare provider for alleged negligence and product liability that resulted in severe injuries. Darryl Carbone, the plaintiff, filed the complaint in the Superior Court of California, County of Santa Clara on August 7, 2024, targeting Stanford Health Care.

According to the court documents, Carbone visited Stanford Health Care on September 5, 2023, for upper back "trigger point injections." During his visit, he was instructed to lie down on an operating table manufactured by an unidentified company referred to as Defendant Doe No. 2. As Carbone attempted to position himself on the table, it collapsed, causing him to fall onto his right shoulder and face. The attending doctor suggested he go to the Emergency Department immediately. An ambulance transported him there where he was treated by another unnamed defendant referred to as Defendant Doe No. 1. However, Carbone alleges that only his pain complaints were addressed without any imaging tests being performed.

The severity of Carbone's injuries became apparent when he consulted his primary care physician a day or two later. Subsequent X-rays and an MRI revealed that he had suffered a torn rotator cuff and torn tendons in his right shoulder. Carbone claims these injuries are a direct result of both Stanford Health Care's negligence in maintaining their equipment and the substandard medical care provided by their staff.

The complaint outlines multiple causes of action including professional negligence against all health care provider defendants and strict product liability against Defendant Doe No. 2 for manufacturing the defective operating table. Specifically, Carbone accuses Stanford Health Care of failing to ensure that their medical equipment was in good working order as mandated by California Code of Regulations Title 22, Division 5, Section 70205. He also alleges that the healthcare provider did not exercise due care in hiring competent staff and ensuring they provided adequate medical care.

Carbone is seeking general damages for negligence along with special damages incurred from medical expenses and future costs related to ongoing treatment. Additionally, he seeks compensation for permanent or temporary disability, emotional distress, loss of earnings both past and prospective, loss of capacity to earn income, and loss of homemaking services.
