Patient Alleges Severe Negligence Against Local Dental Practice

A dental malpractice lawsuit has been filed in Sacramento, California, alleging severe negligence and professional misconduct by a local dental practice. The complaint was lodged by Graciela Vasquez on August 6, 2024, against Nilesh G. Patel, DDS; Purvak V. Parikh, DDS; and their practice, Ascot Family Dental.

The case centers around a series of dental treatments that Ms. Vasquez received at Ascot Family Dental from 2012 through 2023. On May 30, 2023, during a root canal procedure performed by Dr. Patel on her lower right tooth number 31, Ms. Vasquez experienced severe burning pain and swelling in her chin and neck. Despite expressing her discomfort to Dr. Patel and his assistant Ashley, the procedure continued with temporary measures that failed to alleviate her symptoms. The situation escalated when Dr. Parikh intervened but did not inform Ms. Vasquez of a perforation he had identified during the treatment.

Ms. Vasquez's condition worsened significantly after the procedure, leading her to seek emergency medical attention at Kaiser Hospital on May 31, 2023. There she was treated for suspected bacterial infection with morphine, steroids, and IV antibiotics before undergoing an incision and drainage procedure on June 1, 2023.

The lawsuit claims that the defendants were negligent in multiple ways: perforating tooth number 31 without informing Ms. Vasquez; allowing sodium hypochlorite to leach into her gum tissue and bone; failing to provide adequate post-procedure care; and overall deviating from accepted standards of dental practice.

As a result of these alleged acts of negligence, Ms. Vasquez suffered significant physical pain, emotional distress, financial burden due to medical expenses and loss of earnings due to inability to work.

The plaintiff is seeking general damages exceeding the court's jurisdictional limits as well as compensation for medical expenses incurred and future medical costs anticipated due to ongoing treatment needs stemming from the incident.
