Defendants accused of Negligence Leading to Severe Injuries

A tragic incident involving a young child has led to a legal battle in Sacramento. On August 14, 2024, Alora Darnell, represented by her Guardian ad Litem Cory Darnell, filed a complaint in the Superior Court of California, County of Sacramento, against Zoraya Garnica and Brandon Delacruz. The lawsuit accuses the defendants of negligence resulting in severe injuries to the minor.

The complaint outlines that on April 19, 2024, Alora Darnell was placed inside an unsafe bounce house situated on cement in the backyard of Garnica and Delacruz's property at 7117 Chesline Drive, Citrus Heights, California. According to the filing, this act was done negligently and without proper supervision. The plaintiff claims that the defendants failed to exercise reasonable care in managing their property and monitoring Alora, who was only 13 months old at the time.

The document further alleges that all named defendants were acting as agents or employees of each other during the incident and had knowledge of each other's actions. It states that they collectively failed to keep their property safe and neglected their duty to inspect for unsafe conditions or provide adequate warnings about potential hazards.

As a result of this alleged negligence, Alora sustained severe injuries affecting her health and well-being. The complaint describes her suffering from physical pain, mental anguish, and a significant loss of enjoyment in life. Additionally, it mentions that she required medical attention and will continue to incur medical expenses due to these injuries.

The plaintiffs are seeking several forms of relief from the court. They demand compensation for past and future general damages related to physical pain and mental suffering. They also seek special damages for medical expenses incurred so far and any future loss of earning capacity that may arise due to Alora's injuries. Furthermore, they request prejudgment interest on these damages calculated from when the cause of action arose as per California Civil Code provisions.
