A pedestrian is suing the City and County of San Francisco over injuries sustained from a hazardous sidewalk condition. The complaint, filed by Darnell Hughes on August 27, 2024, in the Superior Court of California, County of San Francisco, names the City and County of San Francisco as defendants.
According to the lawsuit, Hughes was walking on Stevenson Street in San Francisco on August 22, 2023, when he fell into an uncovered hole on the sidewalk. The plaintiff claims that this public property was in a dangerous condition that posed a substantial risk to pedestrians. Hughes asserts that the defendants had ample notice of this hazard but failed to take corrective action. The lawsuit alleges that the negligence of city employees acting within their employment scope contributed to creating this dangerous condition.
Hughes states that as a result of this incident, he has suffered significant physical and emotional pain and may face permanent disabilities. He also mentions incurring medical expenses and experiencing a loss in earning capacity due to his injuries. "The public entity Defendant(s) had notice of the dangerous condition involving the pavement defect for a long enough time to have protected against it," reads part of the complaint.
The plaintiff seeks general damages exceeding the court's jurisdictional minimum, compensation for medical expenses, lost earnings, and other relief deemed appropriate by the court. Hughes is also requesting a jury trial.
