Patient Sues San Francisco Eye Clinic for Alleged Medical Negligence

A recent court filing reveals a troubling case of alleged medical negligence that has left a patient with permanent vision impairment. Paul Cummins filed the complaint in the Superior Court of California, County of San Francisco, on September 4, 2024, against Dr. Kevin Denny and his practice, Denny Eye & Laser Center.

According to the lawsuit, Cummins engaged Dr. Denny and his clinic to perform cataract surgery on his left eye on July 25, 2023. The procedure took place on September 6, 2023. However, Cummins alleges that Dr. Denny and his team performed the surgery negligently and recklessly, resulting in irreversible damage to his vision. "As a direct and legal result of the negligence of Defendants," the complaint states, "Plaintiff has suffered permanent and irreversible impairment of vision in Plaintiff's left eye and related injuries."

Cummins claims that this negligent act has caused him severe personal injuries, pain, suffering, and significant financial losses due to medical expenses and loss of earnings capacity. The plaintiff is seeking general damages according to California Code of Civil Procedure Sections 425.10 and 425.11 for disabling injuries and pain suffered. Additionally, he demands compensation for medical services required due to these injuries and for lost earnings both past and future.

The complaint also includes unnamed defendants referred to as "Does 1 through 100," whose identities are currently unknown but are believed by Cummins to have played a role in causing his injuries through their actions as agents or employees within the scope of their employment at Denny Eye & Laser Center.

Represented by attorney William F. Flahavan from Flahavan Law Offices based in Westlake Village, CA, Cummins seeks not only compensatory damages but also coverage for all costs incurred during the litigation process.
