Passenger Alleges Negligence Against Driver and Vehicle Owner Following SR-99 Accident

A tragic accident on SR-99 has led to a lawsuit that highlights the severe consequences of negligent driving. On August 30, 2024, Ahmad Khalaf, represented by his conservator Hassan Khalaf, filed a complaint in the Superior Court of California, County of Sacramento, against Andre Michael Hillhamiel and Carolyn Mitchell. The suit alleges that Hillhamiel's reckless driving caused significant injuries to Ahmad Khalaf.

According to the complaint, on March 16, 2023, Andre Michael Hillhamiel was driving a 2015 Ford transit van owned by Carolyn Mitchell. With Ahmad Khalaf as a passenger, Hillhamiel unsafely changed lanes on northbound SR-99 in Sacramento, resulting in a collision with another vehicle. This incident allegedly caused severe injuries to Khalaf. The plaintiff contends that Hillhamiel’s actions were not only negligent but also conducted with the consent and knowledge of all defendants involved.

The complaint details various forms of negligence attributed to the defendants. It states that they "negligently and carelessly entrusted, managed, maintained, controlled, owned, and operated" the vehicle involved in the accident. As a result of this negligence, Ahmad Khalaf sustained injuries that have caused ongoing physical and mental pain and suffering. The complaint further alleges that these injuries will likely result in permanent disability for Khalaf.

In addition to physical suffering, the plaintiff claims financial losses due to medical expenses and loss of earnings. Since the accident, Khalaf has required continuous medical care and has been unable to attend his usual occupation. The lawsuit seeks compensation for these losses along with general damages exceeding $35,000.

The plaintiff is seeking several forms of relief from the court: general damages according to proof at trial; compensation for loss of income and earning capacity; reimbursement for medical expenses; prejudgment interest on awarded damages; costs of suit; and any other relief deemed proper by the court.
