A Sacramento woman is suing a local restaurant after suffering severe burns from hot soup. Isabella Soileau filed a complaint in the Superior Court of California, County of Sacramento, on September 6, 2024, against Pho Viet 2 LLC and unnamed defendants.
According to the complaint, Soileau visited Pho Viet 2 restaurant at 1589 W. El Camino Avenue, Unit 105, Sacramento, CA on May 4, 2023. At approximately 7:30 p.m., she purchased soup that subsequently spilled on her, causing second and third-degree burns. The plaintiff alleges that the restaurant served the soup at an unsafe temperature and was negligent in handling, preparing, serving, and offering the food. "Defendants were careless and negligent so as to allow soup to be served to customers at unsafe temperatures," states the complaint.
Soileau claims that due to this negligence, she has incurred medical expenses for treating her injuries and anticipates future costs as some injuries may be permanent. She also asserts that her ability to work has been affected, leading to a reduction in earning capacity and loss of wages. The lawsuit highlights multiple layers of alleged negligence involving not just the business entity but also individual employees who were responsible for food preparation.
The plaintiff is seeking general damages according to proof presented in court as well as special damages related to medical expenses and lost wages. Additionally, she seeks compensation for the costs of the suit and pre-judgment and post-judgment interest.
