Shopper Sues Shopping Outlet Over Dangerous Walkway

A dangerous and defective condition at a popular shopping outlet has led to a significant personal injury lawsuit. On September 12, 2024, Jana Malm filed a complaint in the Superior Court of California, County of Sacramento, against Simon Property Group, Inc., Folsom Premium Outlets, and other unnamed defendants.

According to the complaint, the incident occurred on October 13, 2022, at Folsom Premium Outlets located at 13000 Folsom Blvd in Folsom, California. Malm alleges that while walking on the premises, she encountered a raised, damaged, cracked, offset, twisted, and uneven walkway or sidewalk. This hazardous condition caused her to trip and fall violently onto the ground. The plaintiff asserts that the defendants negligently maintained and supervised the premises leading to her injuries.

Malm's complaint further details that all named defendants were responsible for maintaining the safety of the premises. She claims they failed to inspect and repair the dangerous condition despite having actual or constructive knowledge of its existence. "Defendants acted negligently and carelessly," states Malm in her filing. She argues that this negligence directly resulted in her physical injuries and ongoing pain and suffering.

The plaintiff is seeking general damages according to proof for her physical injuries as well as medical expenses incurred from employing healthcare providers such as physicians and chiropractors. Additionally, she requests prejudgment interest, attorney fees, costs of suit incurred during litigation, and any other relief deemed just by the court.
