Former Employee Alleges Multiple Labor Violations Against Bonney Plumbing LLC

A California worker has launched a class-action lawsuit against his former employer, alleging a series of labor law violations that affected not only him but also numerous other employees. Nathaniel Swaney Henry filed the complaint in the Superior Court of California, County of Sacramento, on September 13, 2024, targeting Bonney Plumbing LLC and its associated entities.

Henry's lawsuit claims that Bonney Plumbing LLC systematically violated multiple provisions of the California Labor Code and Industrial Welfare Commission (IWC) orders. The plaintiff asserts that he and other non-exempt hourly employees were regularly denied proper wages for all hours worked, including overtime pay. "Defendants required Plaintiff and the Employees in the Class to perform work while remaining under Defendants’ control during their meal breaks," reads one section of the complaint. This practice allegedly resulted in inaccurate wage statements and prevented employees from learning about these unlawful pay practices.

The plaintiff also alleges that Bonney Plumbing failed to provide lawful meal and rest periods. According to Henry, employees were consistently required to work through their breaks without compensation. "Employees were not provided with the opportunity to take timely, uninterrupted, and duty-free meal and rest periods as required by the Labor Code," states another part of the filing. Furthermore, Henry contends that the company did not reimburse necessary business expenditures incurred by employees or maintain accurate payroll records as mandated by law.

Henry is seeking various forms of relief from the court. These include compensatory damages for unpaid minimum wages and overtime compensation dating back four years prior to filing this action. He also seeks liquidated damages equal to unpaid minimum wages plus interest, penalties for failing to provide accurate wage statements, reimbursement for business expenses, and statutory penalties under several sections of the California Labor Code. Additionally, Henry requests injunctive relief to prevent Bonney Plumbing from continuing these alleged unlawful practices.
