A family is seeking justice after a tragic incident at a hospital allegedly led to the wrongful death of their loved one. On September 19, 2024, Maria Elena Nunez Nuno filed a complaint in the Superior Court of California, County of Sacramento, against Adventist Health Lodi Memorial Hospital and Dr. Chude Anene Anagar.

The lawsuit details the harrowing events leading up to the death of Jose Manuel Nunez Real on July 10, 2023. According to the complaint, Jose Manuel Nunez Real was admitted to Adventist Health Lodi Memorial Hospital on July 8 and 9, 2023, for shortness of breath, abdominal pain, and diabetes management. The plaintiffs allege that during his stay at the hospital, Jose Manuel fell in the emergency department due to negligence on the part of the healthcare providers. The fall resulted in severe injuries that ultimately led to his death two days later.

Maria Elena Nunez Nuno claims that the defendants failed in their duty to provide adequate medical care and ensure her husband's safety. The complaint states: "Defendants negligently acted towards the Decedent by failing to obtain informed consent, communicate critical facts to other healthcare providers, and ensure proper precautions regarding fall risks." The plaintiffs argue that these failures directly caused Jose Manuel's injuries and subsequent death.

The plaintiffs are seeking general damages for loss of companionship and emotional support from Jose Manuel. They also seek compensation for pre-death pain and suffering experienced by Jose Manuel due to alleged medical negligence. Additionally, they are requesting reimbursement for past and future medical expenses related to this incident as well as funeral and burial costs.

The legal team representing Maria Elena Nunez Nuno includes Steven H. Schultz from Schultz Law Group and Aimee Clark Newberry from Clark Newberry Law Firm.
