Former Bartender Sues Local Restaurant Chain Over Multiple Labor Law Violations

In a striking legal development, an individual has taken significant legal action against a local business entity, alleging numerous labor law violations. Wade Conlee Jackson filed the complaint in the Superior Court of California, County of Santa Clara on September 19, 2024, targeting Sushi Confidential Morgan Hill.

The plaintiff, Wade Conlee Jackson, accuses Sushi Confidential Morgan Hill of multiple infractions during his employment from June 13, 2022, to February 21, 2024. According to Jackson's complaint, he was employed as a bartender and faced various workplace issues that violated California labor laws. The allegations include failure to pay meal period compensation (Cal. Lab. Code § 226.7), rest break compensation (Cal. Lab. Code § 226.7), sick days (Cal. Lab. Code §§ 245-249), timely wages (Cal. Lab. Code § 204), reporting time wages (Cal. Lab. Code §§ 204, 206, 216, 218.5, and 218.6), and reimbursement for necessary expenditures incurred during work duties (Cal. Lab. Code § 2802). Additionally, Jackson claims that the company failed to furnish compliant wage statements (Cal. Lab. Code §§ 226 and 226.3) and pay minimum wage (Cal. Lab. Code §§ 1182, 1194, and 1197).

Jackson's detailed account describes how he was often forced to prioritize work over his legally mandated breaks due to heavy workloads and understaffing at Sushi Confidential Morgan Hill: "Specifically," he notes in the filing, "he was required to prioritize work over his breaks due to a heavy workload as well as a lack of relief." He further alleges that despite raising these concerns with management, they were ignored.

Moreover, Jackson asserts that he did not receive proper compensation for sick days or timely payment of wages upon termination: "DEFENDANT failed to pay PLAINTIFF all wages owed at the time of his termination," reads one part of the complaint.

Jackson also highlights other labor violations such as not being reimbursed for business expenses like bar mats and square ice cube trays needed for his job duties: "PLAINTIFF had to purchase bar mats and square ice cube trays for use at the bar."

As part of his legal recourse, Jackson is seeking several forms of relief from the court including payment for earned wages and overtime compensation according to proof presented at trial by jury; statutory obligations and penalties; civil penalties; an accounting under his administration subject to court review; injunctive relief compelling production of employment files or wage records; declaration of rights and interests; prejudgment interest at the legal rate; attorney’s fees and costs; restitution and disgorgement of ill-gotten profits; punitive damages sufficient to punish wrongful conduct alleged in this case; among other appropriate reliefs deemed fit by the court.
