A woman alleges negligence and premises liability against a major retail corporation after a slip-and-fall incident left her with serious injuries. Shahinaz Nayef Alhmoud filed the complaint in the Superior Court of California, County of Santa Clara, on September 16, 2024, naming Walmart, Inc., and its employee Manuel Urias as defendants.
According to the court documents, Alhmoud was visiting the Walmart store located at 777 Story Road in San Jose on September 27, 2022. She claims that while walking through the store, she slipped and fell on melted ice that had accumulated on the floor. The lawsuit alleges that this dangerous condition was due to Walmart's failure to properly maintain its premises. "Defendants negligently, willfully, carelessly, recklessly, and unlawfully owned, possessed, maintained, operated, supervised, managed, controlled... said premises," states the complaint.
Alhmoud asserts that Manuel Urias was acting within his capacity as store manager at the time of the incident. She believes Urias had both the responsibility and authority from Walmart to manage and control the premises but failed to ensure a safe environment for customers. The complaint further alleges that employees created this hazardous condition and did not warn customers or take measures to mitigate it.
The plaintiff claims she has suffered significant physical injuries resulting in great mental and physical pain. Additionally, she argues that these injuries have led to substantial medical expenses and loss of earnings due to diminished future earning capacity. Alhmoud is seeking general damages according to proof at trial but exceeding minimal jurisdictional limits of the court. She also seeks special damages for medical expenses and personal property damages.
