The lawsuit centers around allegations that the defendants failed to provide adequate medical care to Ling La, particularly concerning the treatment of recurrent urinary tract infections (UTIs). According to the complaint, La had been prescribed Nitrofurantoin Macro for UTI prevention since October 17, 2014. However, on May 22, 2023, Nurse Practitioner Kathleen Shrader denied a refill request for this medication due to concerns about antibiotic overuse and resistance. This decision led to a series of events where La experienced severe symptoms associated with UTIs but was unable to obtain her usual medication.
La claims that despite having tested positive for UTIs in the past, both Dr. Irene Ly and Dr. Sarah Rosenwohl-Mack refused to prescribe Nitrofurantoin Macro after reviewing only partial medical records. This refusal allegedly occurred without conducting a thorough examination or considering La's complete medical history. As a result of this alleged negligence, La suffered from pain, discomfort, insomnia, and emotional distress due to untreated UTIs.
The plaintiff argues that the actions of the defendants constitute a breach of their duty of care as healthcare providers contracted with San Francisco Health Plan (SFHP). She contends that their failure to accurately diagnose and treat her condition has caused significant harm and suffering.
In her complaint, Ling La seeks various forms of relief from the court. She requests general damages exceeding $25,000 for physical and emotional injuries sustained due to the defendants' alleged negligence. Additionally, she seeks compensation for past and future medical expenses incurred as a result of inadequate treatment. The plaintiff also demands damages for loss of earnings and loss of society and comfort.
