Property Owner Alleges Breach of Contract Against Developer Over Faulty Renovations

Malcolm Handley and 22 Day Street LLC have filed a lawsuit against multiple defendants, alleging breach of contract and fraud related to property renovations. The complaint was filed on October 21, 2024, in the Superior Court of California, County of San Francisco, targeting SS Dev, LLC, Rodrigo Santos, Santos & Urrutia Associates, Inc., PJD Construction, Inc., and unnamed defendants.

The plaintiffs accuse the defendants of failing to perform renovation work according to industry standards and legal requirements. Malcolm Handley and his company purchased a property at 22 Day Street in San Francisco in early 2021, believing it had been renovated with all necessary permits. However, they later discovered numerous defects. Notably, Rodrigo Santos was recently sentenced to prison for unrelated charges.

According to the complaint, SS Dev partnered with PJD Construction for the property's renovation. The plaintiffs allege that critical aspects of the renovation were either not disclosed or improperly executed. For instance, showers installed by PJD were found to be non-water-tight due to defective components. Additionally, a new roof installation was deemed substandard and not disclosed as required by law.

The plaintiffs also claim that rear decks and staircases were constructed without proper permits. They have since applied for a variance from the Zoning Administrator to rectify this issue but face potential reconstruction costs if denied.

Further allegations involve post-purchase work by PJD Construction and Santos. The plaintiffs contracted them for additional installations but later learned these were done without necessary permits. As a result of these alleged breaches and misrepresentations, the plaintiffs incurred significant financial losses amounting to $191,818.09.

Handley and his company seek compensatory damages for repair costs already incurred and estimated future expenses totaling over $237,000. They also demand punitive damages due to alleged fraudulent actions by the defendants.

Represented by Gregory J. Wood from Wood Litigation APC, Malcolm Handley seeks justice against SS Dev's alleged negligence alongside PJD Construction's purported deceitful practices regarding construction permits and project disclosures.
