In a sweeping class action lawsuit, a former employee has accused a Nevada-based corporation of numerous labor violations, alleging the company failed to comply with California's labor laws. The complaint was filed by Skye Molina on October 30, 2024, in the Superior Court of California for the County of Santa Clara against JC Group International, Inc.
The case revolves around allegations that JC Group International, Inc., along with unnamed defendants referred to as Does 1 through 10, engaged in unlawful business practices that violated several provisions of the California Labor Code. The plaintiff claims that during her employment from December 2023 to present, she and other similarly situated employees were not paid for all hours worked, including minimum and overtime wages. Additionally, Molina accuses the company of failing to provide legally mandated meal and rest periods and not paying final wages promptly upon termination.
Molina asserts that these actions are in direct violation of multiple sections of the California Labor Code and the Business & Professions Code. She alleges that "Defendants have obtained valuable property, money and services from Plaintiff," depriving her and others of their rightful earnings. Furthermore, she contends that JC Group International's conduct was willful and deliberate, claiming they were aware of their legal obligations but chose not to comply.
The lawsuit seeks various forms of relief from the court. Molina is pursuing unpaid wages for herself and other class members affected by these alleged violations. She also seeks statutory penalties for failure to provide accurate wage statements and indemnification for work-related expenses incurred by employees. Additionally, Molina requests injunctive relief to prevent future violations by JC Group International and restitution for unfair business practices under California’s Unfair Competition Law.
Representing Molina are attorneys John G. Yslas, William M. Pao, and W. Christina Chang from Wilshire Law Firm. The case has been assigned Case No.: 24CV450643 in front of Judge Y. Chavez at the Superior Court of California in Santa Clara County.
